Who must sign the application form?
This article explains whether a signature is required for your eHerkenning application, depending on your situation. It also outlines when multiple signatures are required.
Authorization Requirements for an eHerkenning Application
When applying for eHerkenning, approval is required from the authorized representative(s) (director or managing director) of the relevant organization. The extract from the Dutch Chamber of Commerce (KvK) identifies who the authorized representative(s) are.
If multiple authorized representatives are listed on the C.o.C (KvK) extract, the application for eHerkenning generally must be signed by the majority of these representatives.
Depending on how the signing authority is registered and the eHerkenning assurance level being requested, the number of required signatures may vary. See the overview below.
| eHerkenning Level | Sole Authority | Joint Authority | Limited Authority | Authorized Representatives (Power of Attorney) |
|---|---|---|---|---|
| EH2+ | One signature | Two signatures | Two signatures | Full power of attorney or a specific power of attorney for eHerkenning |
| EH3 | One signature | Majority of the total number of directors* | Majority of the total number of directors* | Full power of attorney or a specific power of attorney for eHerkenning |
| EH4 | Both the director(s) and the user must sign the application and identify themselves in person. No restrictions on signing authority are permitted. | Both the director(s) and the user must sign the application and identify themselves in person. *If the Articles of Association specify that signing authority for all matters is vested in a specific number of directors, or if other signing arrangements apply to your organization, we can accept these provided that the relevant official documents are submitted with your application. These documents must clearly demonstrate that the designated individuals are jointly authorized to represent the organization, even if additional directors are registered.
Who Can Apply?Anyone may submit an application for eHerkenning, provided that it is signed by the organization's authorized representative(s).
The C.o.C (KvK) extract identifies the authorized representative(s) under the sections Owner, Directors, or Authorized Representatives, and specifies the extent of each person's signing authority.
No Natural Person Listed as Authorized Representative?Legal Entity (B.V., N.V., etc.)
If another legal entity is listed under Directors or Authorized Representatives on the KvK extract, the details of the authorized natural person can be found in the KvK extract of that legal entity.
A copy of this parent organization's KvK extract must also be submitted with your application. We always require a natural person to be registered as the organization's representative.
Government Organizations
If you are applying on behalf of a government organization, you may demonstrate the applicant's authority by submitting supporting documents, such as a mandate, appointment letter, or similar official documentation. A copy of these documents must be included with your application.
Applications for Municipalities
For municipalities, the Mayor is always independently authorized to represent the municipality.
In this case, we recommend appointing an Authorization Manager with administrator rights. This allows future eHerkenning applications to be submitted without having to list the Mayor as the authorized representative for every application.
